Problem 4: You are a Nevada trial judge. The defendant has been charged with various crimes, based on the following facts: He and his wife were separated. They agreed the couple's children would live with the wife in the marital house, which was owned by the defendant, during the week, and that the defendant would spend the weekends at the house. However, this arrangement broke down when another man began living with his wife at the house. After making threats, in the early morning hours on a Friday, defendant entered the house, and shot his wife and the other man. The wife died from the gunshot wounds. One of the charges against the defendant is burglary, under the Nevada burglary statute. It defines burglary as entering "any house or building" with intent to commit a crime. Defendant has filed a pretrial motion to dismiss the burglary charge, contending one cannot be guilty of burglary of one's own house. The state contends the statue says "any house", and that is what it means. Should you grant the motion? Or does "any house" actually mean "any house of another"?
