Freddy is stopped for DWI/ DUI. He tells Officer Gannon that his former employer, Bob, is engaged in mortgage fraud. Freddy says that Bob has sent him several emails to enlist him in fraudulent activity, but Freddy has declined. Officer Gannon asks Freddy if he (Officer Gannon) can look at the emails Bob has sent to Freddy. Freddy agrees.
Bob is charged with soliciting a felony based on the emails. His attorney moves to suppress the content of the emails on the grounds that they were obtained by violating Bob's 4th Amendment rights. Will his motion be successful? Explain why or why not.
