Discussion about trial of smith v. jones

Problem:

During the trial of Smith v. Jones, a civil action for theft of a puppy, Smith attempts to introduce evidence that Jones doesn't go to church. The court allows this information to come into trial. If the court finds that this issue affects a substantial right, but not a fundamental right, Jones must object in order to preserve this issue on appeal.
