Discussion about public policy against gambling


Problem: Courts generally will hold gambling contracts to be void consistent with a view that gambling is illegal as a matter of public policy. However, we now have every state in the Union sponsoring some form of gambling...state run lotteries. Additionally, several states permit casino gambling, with slots and table games, and there is sports gambling. (Are you tired of all the sports betting commercials yet?!) Do you think it may be time to shed this view by the courts that gambling contracts should not be enforced as a matter of public policy against gambling?
