Problem: The period of mega constitutional politics was a tumultuous one that nearly broke up Canada, but in the end produced a patriated constitution, a Charter of Rights and Freedoms, and a period of non-constitutional reforms and approaches which predominate today. What lessons can we learn from all of this? Given the difficulties currently confronting the governments of Canada with the covid crisis, should we return to questions about the division of powers and constitutional reform? How would you divide the powers between the federal and provincial governments if you were to redesign the constitution today? Would you include "the people" in amending the constitution through a referendum, or leave it up to the elected representatives of the people?
