I represented a client who was selling her home. The Buyers (Buyer #1), breached the contract by failing to properly satisfy the mortgage contingency. Fortunately, she was then able to sell to another party (Buyer #2). If my client decides to sue, she will be entitled to damages which would include: the difference between the selling price of the contract with Buyer #1 and Buyer #2, carrying costs paid for the period of time that it took for my client to close on the sale of her home to Buyer #2 - such as utilities, insurance and real estate taxes, as well as legal fees that she paid to me!
