Problem: In the landmark case of R v AM, [2008] 1 S.C.R. 569, 2008 SCC 19, the supreme court of Canada noted that the search with a sniffer dog:
- Violated the students' rights (section 8 of the Canadian Charter)
- Police do not have the right to perform a search without a reasonable suspicion
- Students are entitled to privacy in a school environment
- Section 24(2) of the Charter requires that the admissibility of evidence obtained in violation of an individual's Charter rights be considered
- All of the above.
