Officer Jones is a veteran officer with the Smithville police department. He received information that a citizen living in the local housing project was selling drugs. This information was conveyed to Officer Jones by an anonymous caller to the officer on his personal cell phone. Officer Jones immediately went to the housing project and stopped the citizen as he was leaving his apartment. Officer Jones searched the citizen and found drugs.

Identify the constitutional amendment that would govern Officer Jones' actions. In your own opinion, discuss if you support his actions or not. Justify your answer using the appropriate case law and Supreme Court precedents.

The Bill of Rights finds its roots in documents such as the British Magna Carta of 1215 AD. It was one of the first documents that provided the common man independence from a monarch. It did imply that the federal government's law dominated all others; however, it gave each state control of any laws outside of those reserved to the federal government. The Bill of Rights acts as a blueprint that every individual state uses to protect the rights of individual citizens. Case Study 2: Plain View, Open Fields, Abandonment, and Border Searches as They Relate to Search and Seizures
Officer Jones asked the neighborhood's regular trash collector to put the content of the defendant's garbage that was left on the curb in plastic bags and to turn over the bags to him at the end of the day. The trash collector did as the officer asked in order to not mix the garbage once he collected the defendant's garbage. The officer searched through the garbage and found items indicative of narcotics use. The officer then recited the information that was obtained from the trash in an affidavit in support of a warrant to search the defendant's home. The officer encountered the defendant at the house later that day upon execution of the warrant. The officer found quantities of cocaine and marijuana during the search and arrested the defendant on felony narcotics charges.

Case Study 3: Confessions and Admissions after a Request for a Lawyer
A suspect is apprehended in a large-chain grocery store by the security guard. The suspect is placed in handcuffs and taken to the manager's office. The police are called and advised of the situation. Officer Jones arrives at the store approximately 12 minutes later. Officer Jones takes a statement from the security guard and views the in-store camera film of the shop lifting incident. Officer Jones places the suspect under arrest, reads the suspect the Miranda warnings, and asks the suspect if he would like to make a statement. The suspect replies, "No, I would like a lawyer". The suspect is then transported to the local jail and booked. Five (5) hours later, the suspect is interviewed by a detective who again reads him the Miranda warning. The detective then asks the suspect if he would like to talk. The suspect says, "Yes". He eventually confesses to the crime.
