Problem: The House of Lords Select Committee on the Mental Capacity Act 2005 published its opinion on 12 March 2014. With regard to the Deprivation of Liberty Safeguards the Committee stated:
'The provisions are poorly drafted, overly complex and bear no?relationship to the language and ethos of the Mental Capacity Act. The safeguards?are not well understood and are poorly implemented..."
Critically analyse this statement in the light of the changes introduced by the Mental Capacity (Amendment) Act 2019.
