This discussion will cover the Plain View Doctrine and how it applies to the Fourth Amendment "Search & Seizure" protection in cyberspace, computers, cell-phones and information shared there-in (company equipment has been well adjudicated, but personal equipment decisions are all over the board in State and Federal Courts).

The plain view doctrine allows an officer to seize--without a warrant--evidence and contraband found in plain view during a lawful observation.
For the plain view doctrine to apply for discoveries, the three-prong Horton test requires:

1. the officer to be lawfully present at the place where the evidence can be plainly viewed,

2. the officer to have a lawful right of access to the object, and

3. the incriminating character of the object to be "immediately apparent.

B. Discuss a type of profiling done by the government and/or businesses (sales/marketing). One area of thought is social media's collection of our likes, dislikes what we purchase, advertisements, age, voting, etc. This is a quick review on current methods of profiling. What commonalities do you see with U.S. citizen profiling vs. Criminal Justice profiling done against Terrorists, serial killers and rapists, etc.How much of this type of citizen profiling is right or wrong? Too intrusive or OK for some and not for others?
