As we begin our study of “discovery”, consider this a working definition of that term:
Discovery is a fact-finding process and procedure—often governed by court rules and state rules of evidence—that takes place after a lawsuit has been filed and before trial, in order to allow both parties in the case to prepare for either settlement or trial. It is based upon the belief that a free exchange of information is more likely to help uncover the truth regarding the facts that are in dispute.
