Disciplinary action in outsourcing

Question:
One of the feel outs of globalization has been the outsourcing of work from one employer to another, and sometimes from one country to another. The blurring of the relationship affects not only legal responsibilities but also grievance and disciplinary issues. How in your opinion should disciplinary action occur when, say, a Chinese company has outsourced part of its work to another company in Malaysia?
