Describe surviving spouse as community property


Assignment task: Decedent died owning a parcel of realty, but its classification of separate or community property was uncertain. A lower state court determined that the property was held by the decedent and his surviving spouse as community property. Is the Service precluded from contending that the property was the separate property of the decedent? See Estate of Kenly v. Commissioner, T.C. Memo 1996-516.
