Assignment Task: Once the government eased the COVID-19 measures, Concert Planners Pte Lid ("CP") quickly negotiated with and engaged Justin B, a popular singer, to perform a series of 2 concerts in Singapore in August 2022 as part of his World Tour. The terms of the contract also stated that Justin B was to attend 2 Meet-the-Fans sessions in Singapore scheduled on 10 and 1 1 June 2022. Justin B signed the contract.
On 5 June 2022, Justin B became ill with a rare disease and had to cancel his different engagements to rest and recover. CP was also informed that Justin B would not be able to attend the 2 Meet-the-Fans sessions scheduled on 10 and 11 June 2022. However, Justin B believed that he would be well enough to perform at the concerts in August 2022.
The Managing Director of CP sought your advice on the following issues.
Required:
(a) Define "terms" of a contract and state the TWO (2) types of terms commonly found in a contract.
(b ) Discuss whether CP is entitled to terminate the contract with Justin B due to his failure to attend the 2 Meet-the-Fans sessions.
(c) Assuming that Justin B was able to attend the 2 Meet-the-Fans Sessions but was unable to perform at the concerts, advise CP on the appropriate cause of action and their remedies. Support your answers using relevant case law.
