Place corporation orally contracted with Alto to work as Place's agent on customer service calls. Alto was authorized to customize Place's software to the customer's needs on a commission basis but NOT to sell Place's hardware computers. On 9/15 Alto made a service call on Teal to repair Teal's computer. In the past, Alto called on Teal , repaired computers and collected cash for the repairs. During the call, Alto sold Teal a computer from Place at a reduced cost but Teal had no knowledge that he was getting the computer at a reduced cost. Teal paid $1000.00 towards the purchase of the computer. Alto pocketed the money and left town. Place refused to honor the deal. Referring to the above scenario, both place and Alto are contractually liable to Teal.
