Resolve Business Disputes Task - Dispute Resolution Procedures Assignment
Aim: To be able to develop and implement dispute resolution procedures.
Provide a step by step process that would prevent litigation in most cases (include a flow chart) relating to supervision record keeping and implementation of a Dispute Resolution Procedure associated with any project and any relevant building contract. Include the following items in your assignment submission:
- Project Identification - Including a brief on how to outline the scope of work to avoid confusion.
- Allowance for identification of contract type to be used with any project to avoid potential disputes.
- List the rules regarding the relevant clauses in the project contract (consider responsibility, supervision, record keeping and implementation and consultation).
- Provide your own step by step process for resolving disputes that can prevent litigation in most cases.
- Include examples of support documentation that should accompany each step of the process for resolving disputes (make allowance for this documentation to be used later in the review process).
- Nominate the obligations of the relevant parties relating to agreement of procedures including allowance for alternative dispute resolution (consider Principal, Contractor & Sub Contractor etc...).
- Provision for a Contingency Plan should the process fail (situation becomes completely out of control).
- Provide a review procedure (that is:- what reports should be completed by whom, when, how often, and how to follow the procedure of review and implement improvements especially in cases of failure).
