Sarah, a personal trainer at Mr. Muscle's Fitness Center, had to take a day off a few weeks ago because she had to go to Court and testify in a case against Bubba, her former significant other, who was charged with domestic battery against her. After Court she shares with her boss, the General Manager, that due to a technicality the charges were dismissed. Sarah's boss shrugs her shoulders and says too bad.
Today, Bubba shows up at Sarah's work and loudly confronts her in a threatening manner. Clark, a co-worker of Sarah's, tries to intervene and asks Bubba to leave the premises. Bubba, using a concealed weapon, seriously injures Clark and runs out the Fitness Center. Bubba is later arrested and sent to prison.
Clark files a lawsuit against Mr. Muscle's Fitness Center seeking damages for his injuries. Under these facts should Clark prevail? Why or why not?
