Problem:
Mark works for Grasslands Surveyors, Inc. as the surveyor. As part of his job, Mark has to drive all over Texas measuring and surveying land for his company. While driving in his company truck to one of his job sites, Mark starts texting his friends while driving. He gets so caught up in texting, that he accidentally swerves and hits oncoming vehicle causing damage to both company truck and the other vehicle. The owners of other vehicle sue Grasslands Surveyors, Inc. for damages to their vehicle and for their medical expenditures as a result of the crash. Will Grasslands Surveyors, Inc. be found vicariously accountable for Mark’s driving? Discuss why or why not in detail.
