Case Problem:
Leno joined a scuba diving class at the YMCA. The class was taught by an instructor who contributed his services to the YMCA and was not remunerated for them. The course was advertised by the YMCA, and Leno paid the YMCA for the course. Leno died as a result of an accident, and a suit was brought against the YMCA, claiming the instructor was an agent of the YMCA. Is this claim correct? (Leno v. Young Men’s Christian Association of San Francisco, 17 Cal. App. 651)
