Problem
Lawyers Holland and Huang share an office space. They are two of a dozen lawyers who share a common receptionist, a common conference room, and a common lobby. The receptionist takes all calls and gives messages to the individual lawyers. However, the lawyers have their own stationary, paralegals, and telephone lines. Given the office set up, the clients in the office are visible to all. Lawyer Huang, specifically, sits within hearing distance of the receptionist. Lawyers Holland and Huang have offices down the hall from one another. Client Jacobs and Client Johnson have a bitter custody battle. Lawyer Holland represents Client Jacobs.
Client Johnson now desires to hire Lawyer Huang. Can Lawyer Huang ethically take Client Johnson's case? Explain your answer.
