Bob purchased a long-term disability insurance policy from the Good Hands Insurance Company five years ago. Last month, he was injured while skydiving in Afghanistan. Taliban fighters shot a surface-to-air missile at a nearby helicopter and the missile went through Bob’s parachute before exploding harmlessly in the air. No one in the helicopter was injured. Bob had limited control over the chute with the hole in it and he broke his leg when he hit the ground. Bob is an NFL running back. His injuries are such that he cannot play football for one year while his leg heals. Bob has filed a claim for payments under his disability policy. He asserts that he is totally disabled. The definition of total disability in the insuring agreement of the policy is “unable to perform the duties of your occupation.”
