Question: Blette contracted with ANC in May 2008 for a one-year apartment lease at $605 per month. In February 2009, Blette complained to ANC about substandard maintenance and other problems. Blette tendered a $752.54 check and wrote an accompanying letter saying that the payment was to settle her forthcoming March, April, and May rent minus her alleged damages. She also wrote that if the check were cashed her terms were being accepted. ANC wrote back saying it would cash the check but that her demands were unacceptable.
