Arthur Dent left his local pub at one in the morning after having consumed eight beers. As he drove home he hit a car driven by Trillian, killing her and destroying her car. In California vehicular manslaughter is punishable by up to seven years of imprisonment. Trillian's estate sues Arthur following the accident for wrongful death. At trial Arthur requests a jury trial, which the judge refuses. Arthur appeals the judge's decision. Is he likely to succeed in his appeal? Why?
