Assignment task:
1. Read the article on the Facebook appeal. The 9th Circuit Court of Appeals ruled that the settlement agreement between the Winklevosses and Facebook (giving the twins a .003% share in the company) was legal and enforceable. Give two specific arguments against the Winklevoss claim that Facebook engaged in fraud by not providing certain information relevant to the settlement.
2. Refer to Problem 15-2. Note the elements of fraud, and discuss whether Tanner can prove each of these elements, so that he would be entitled to avoid the contract under a fraud theory. Apart from your legal analysis, do you think Tanner should be able to get out of the contract? Why or why not?
