(a) Alex, a nurse recently hired by Serenity, gave Barney, a resident at the nursing home, an extra dose of medicine after Barney requested it to help him sleep. Alex was expressly told during her one-day training that medicine should only be given to residents in accordance with a doctor's instructions. The medicine made Barney seriously ill.
b) Milo is an independent contractor providing gardening services to Serenity at the nursing home. One afternoon Milo sneaked into a resident's room, thinking that it would be unoccupied, hoping to steal either cash or jewellery. In fact, Gladys, a resident at the home, was in the room and began to scream. Milo pushed her to the ground and fled out of the room.
(c) Derek is the (employed) manager of the nursing home. A week after the incident in Gladys's room, Tibor, her son, came into the home to complain and ended up having a serious row with Derek. In particular, Tibor insulted Derek and said that "he was not fit to run a bath, nevermind a care home". After Tibor had left, Derek got his address from the care home's database. After work, Derek went round to Tibor's house. On answering the door, Derek punched Tibor telling him, "That'll teach you for what you said this afternoon".
Advise Marylynn as to the vicarious liability of Serenity Limited in respect these events.
