Jared is an orphan as his parents had passed away when he was 10 and his parents had left him with a mansion at Bukit Tunku. Since then, Uncle Lee, the brother of his mother, has provided food, clothing and expenses to Jared until he completed his Bachelor Degree in TAR UC. However, Jared was unemployed and was totally dependent on Uncle Lee for his daily subsistence allowance.
In 2020, Uncle Lee persuaded Jared to sell his mansion, which he inherited from his parents, to him at RM100,000 which was worth at least 50 times more than that amount. Uncle Lee even told Jared to seek advice from a lawyer and property agent on his offer. However, Jared did not seek any advice as he trusted Uncle Lee who has been taking care of him since he was 10 years old. Without hesitation, Jared sold his mansion to Uncle Lee for RM100,000. A month later, Jared discovered the truth and wanted to set aside the contract. Advise Jared on whether he can set aside the contract and succeed in his claim. Explain what is the business law for this question? is it undue influence?
