Problem
B owns and operates an equipment hire shop. He rents out all sorts of equipment, including cutting equipment to customers. One day X comes to his shop and asks to rent some oxy-acetylene cutting equipment.
B knows that X has previous criminal convictions for office breaking and jokingly says to him '1 suppose you are up to your old tricks again!' X replies 'Don't ask so many questions, it might be a bank this time, how else do you think I can make a living these days.' Aid?
Three nights later, X is caught in the act of trying to cut open a safe inside the Mongkok branch of the Good Credit Bank Ltd. X was using the equipment he had hired from B to cut open the safe.
Advise B whether he faces any criminal liability.
