In the TCP, a receiver transmits the acknowledgements only in case it receives any packets from the sender. Therefore, receiving the acknowledgements from the receiver confirms that receiver is continuously receiving something from the sender. Therefore, gap within the packet stream is not because of the severe congestion, however a simple packet loss because of the transmission error. The sender may now send the missing packets before timer get expires. This behaviour is known as the fast retransmit.
